These terms apply from 7 August 2026. They are a contract between you and
XTO Pty. Ltd. (ACN [ACN NOT SET]), of , Australia.
XTO Pty. Ltd. runs suburbrank.com.au and the SuburbRank
service on it. These terms cover everything on this site.
1. Using the site means you agree to these terms
When you use suburbrank.com.au (the site) or buy a pass, you agree to these
terms. If you do not agree, do not use the site. In these terms, we,
us and our mean XTO Pty. Ltd.. You means
the person using the site. If you use it for another person or a company, "you" means both
you and that person or company.
2. Who can use the site
You must be at least 18 years old and legally able to make a contract. The site is made for
use in Australia. It uses Australian law and the published market figures this service ranks only. If you use it from
outside Australia, that is your own choice, and you are responsible for following your local laws.
3. What this service is
SuburbRank is an information and calculation service. It applies
the published market figures this service ranks to the figures you give it and reports what
those rules produce. It shows you its working and names the fee schedule it used.
4. What this service is not
It is not financial product advice, personal advice, legal advice, tax advice,
accounting advice or financial or property investment advice. It is not a recommendation to buy, sell or
otherwise deal in any financial product.
- We do not hold an Australian Financial Services Licence. We are not
authorised representatives of anyone who holds one.
- We do not know your full situation, your goals, your finances or your needs. Nothing
the site produces takes them into account.
- When the site ranks markets, it does so with maths on published
figures: the measures you picked, weighted the way you set them. On purpose, it
leaves out everything a number cannot show: the condition of one particular
property, what is planned for the street, your tax position, how much you can borrow,
a suburb's median price and how much it has moved over the last quarter and the last year, and what really matters to you.
- We get no commission. We have no relationship with any the selling agent, the buyer's agent and the lender you deal with.
Get independent advice from a licensed adviser before you act. Any decision
you make is yours.
5. Accuracy and estimates
We take great care to keep the rates up to date and the formulas correct. Every report
prints the schedule it was built on. Even so:
- Everything the site produces is an estimate based on the figures you entered. If those
figures are wrong, missing something, or out of date, the result will be too.
- the market itself, which is the only thing that sets what a property in any of these suburbs is really worth on the day you buy Those come first, ahead of anything the site produces.
- Rates, thresholds (the levels where a rule starts to apply) and caps (the upper limits)
change through new laws and indexation (regular adjustment for inflation). Laws can
change without notice, and can change things that have already happened.
- Projections (estimates of the future) rely on assumptions about investment returns,
indexation, home values and how long you stay. Nobody can know these for sure, and
they will not turn out exactly right.
Always check before you act.
6. You are responsible for your decisions
You accept and agree that you alone are responsible for judging the results, for
checking them against official sources, for getting independent professional advice, and for
every decision you make or do not make. We are not your adviser, and using the site
does not create an advisory relationship or a fiduciary relationship (a legal duty of
trust) between us.
7. Your account
You must keep your password secret. You are responsible for everything done through your
account. If you think someone else has used your account, tell us straight away at
support@suburbrank.com.au. We may suspend or close an account if we reasonably
believe it is being used to break these terms.
8. Passes, prices and payment
- A pass gives you access to the full report from the moment your payment is confirmed. It
lasts for the period shown on the pass you bought: one week, four
weeks or twelve months. It does not renew, and nothing is charged
automatically. There is no subscription, and we do not keep your card on file.
- Anything you exported while your pass was active stays yours.
The CSV files you downloaded are on your own computer, and nothing we do can reach them.
Your saved searches stay on your account and are still listed after your pass ends.
What ends with the pass is the ability to run them, and to see figures for markets you
have not already exported.
- Prices are in Australian dollars and include GST where GST applies. We may
change prices at any time. The price you see when you buy is the price you pay.
- PayPal processes your payment under its own terms. We never receive your card details.
- A pass is for your own use, or use by one household. You cannot transfer
it to someone else, share it, resell it, or use it to provide a service to other people.
9. Shortlists you export
A shortlist you export is yours to keep. You can show it to a partner, an accountant or
data provider. That licence (permission) is for you personally and not for business
use. It does not let you republish the data, resell it, pass it on to others, or use it as
part of a product or service you provide to other people.
On purpose, the export is one page of results at a time, not the
whole dataset. A pass buys you the use of the data. It does not buy the data itself.
10. Refunds
Our promise: if the data does not cover what you needed, or something has
gone wrong, write to us within 14 days of buying and we will refund your
pass. No forms and no arguments. We would rather give you your money back than have you rely
on a figure that does not fit.
This is a promise we choose to make. It is on top of your rights under the
Australian Consumer Law, and it does not limit those rights. We send refunds to the payment
method you used, within five business days of accepting your request.
11. What you must not do
You must not:
- scrape, crawl, harvest, copy (mirror) or systematically update the site or its content;
- try to get into any account, or any data behind the paywall, without permission;
- reverse engineer, decompile, or otherwise try to work out the source code of any part of the service;
- interfere with how the site runs or with its security, or put an unreasonable load on it;
- resell, sublicense (license on to others) or use the service or its output for commercial gain;
- use the site to give financial, legal or placement advice to other people; or
- use it in a way that breaks the law, or that breaches anyone's rights.
12. Who owns the content
All content, code, calculation methods, report design, text and branding on the site belong
to us or are licensed to us. Copyright and other laws protect them. Nobody owns rates set by
law or government data. But the way we express, arrange and build them is ours.
Nothing in these terms passes ownership to you.
13. Site availability
We aim to keep the site available, but we do not promise that it will always be up, on time,
secure or free of errors. We may change, pause or shut down any part of it, and may do
maintenance, at any time. If we shut down the service for good while your pass is
active, we will refund the part of the pass you did not get to use.
14. Other companies' services
The site relies on services from other companies, including PayPal, Google and the companies
that host the site and send our email. It also links to other sites and government resources.
We are not responsible for those services or sites, whether they are available, what they
contain, or their terms.
15. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the
Australian Consumer Law. If the service has a major failure, you can
cancel your service contract with us and get a refund for the unused part, or get
compensation for the drop in its value. You can also get compensation for any other
loss or damage that could reasonably have been expected. If the failure is not a major
failure, you can ask us to fix the problem in a reasonable time. If we do not, you can
cancel your contract and get a refund for the unused part of the contract.
Nothing in these terms excludes, restricts or changes any consumer guarantee, right
or remedy given by the Australian Consumer Law or any other law, where the law does not
allow that. If any part of these terms would do so, that part
does not apply.
16. Limits on what we are liable for
Section 15, above, always comes first. Subject to that, and as far as the law allows:
- the site and its output are provided "as is" and "as available". We
exclude all warranties, conditions, guarantees and representations (promises about
quality) that these terms do not spell out, whether they are express, implied, set by
statute or otherwise. That includes promises about accuracy, fitness for a particular
purpose, merchantability (being fit for sale) and non-infringement (not breaching
anyone's rights);
- we are not liable for any indirect, incidental, special, punitive or
consequential loss. We are not liable for any loss of profit, revenue, savings,
opportunity, goodwill, data or expected benefit, or for any loss that comes from a
decision you made or did not make because of the site. This applies however the loss
arises, whether in contract, tort (including negligence), under statute or otherwise,
and even if we were told it could happen;
- our total liability to you, for all claims connected with the
site or these terms added together, is limited, at our choice, to supplying the service
again or to refunding the amount you actually paid us in the twelve months before
the claim arose; and
- where the law does not let us exclude liability but does let us limit it, it is limited as set out above.
You agree that this way of sharing the risk is fair, given the price of the service and the
fact that the service is information, not advice.
Our liability is reduced as far as you caused or added to your own loss. That includes
entering wrong figures, not checking results against official sources,
or not getting independent advice.
17. You cover our losses (indemnity)
As far as the law allows, you agree to cover us (indemnify us) for any claim, loss, liability,
cost or expense (including reasonable legal costs) that comes from you breaking these terms,
misusing the site, or giving the site's output to someone else who relies on
it. This does not apply where the claim comes from our own breach, negligence or
deliberate wrongdoing.
18. Ending this agreement
You can stop using the site at any time. We may suspend or end your access straight away
if you break these terms. Sections 4, 5, 6, 9, 12, 15, 16, 17, 19 and 20 keep applying
after this agreement ends.
19. Privacy
Our Privacy Policy is part of these terms. It explains
how we handle your personal information.
20. Which law applies
The laws of New South Wales, Australia govern these terms. You and
we accept the non-exclusive jurisdiction of the courts of New South Wales
(those courts can hear a dispute, but other courts are not ruled out), and of the courts
that hear appeals from them.
21. Other legal terms
- Changes. We may change these terms. When we do, the date at the top
changes. For important changes, we will tell you by email or on the site before they take
effect. The terms in force when you bought a pass are the ones that apply to that purchase.
- If a part cannot be enforced. If a clause cannot be enforced, it is
narrowed (read down) as little as needed, or removed, and the rest still applies.
- Not using a right. If we do not enforce a right, that does not mean we have given it up.
- Passing on this agreement. You may not pass (assign) these terms to
someone else without our consent. We may pass them on if we sell the business.
- The whole agreement. These terms and the Privacy Policy are the whole
agreement between you and us about the site.
